Volunteer Waiver

The activities of Wild Arizona, including the project/event in which I am participating, (the “Event”), are dangerous because of, but not limited to, the rugged wilderness area where the Event may be staged. As such, my participation in the Event may result in loss to myself, my estate, my executors, administrators, personal representatives, assigns, spouse, children, dependants, and all others who might legally be allowed to claim through me (“Myself, My Estate, and My Heirs”). I acknowledge that this potential loss, may include death, personal injury, property damage, and other losses; I acknowledge that I am medically fit to participate in the Event, and that I have informed Wild Arizona staff of any medical conditions that may affect my ability to safely undertake activities in a rugged and remote outdoor setting; I agree to accept for Myself, My Estate, and My Heirs, all the risks involved in participating in the Event;

In participating in the activities of Wild Arizona, including the Event, I acknowledge that I am involved in a common venture with other like-minded wilderness enthusiasts and that I am solely and entirely responsible for myself, my property, and my own safety. Furthermore, I acknowledge that I am voluntarily participating in the Event and am fully aware of the potential risk of harm associated with the Event;

On behalf of Myself, My Estate, and My Heirs, I hereby waive and forever relinquish any claims, which Myself, My Estate, and My Heirs might have against Wild Arizona, and its employees, contractors, volunteers, agents, other participants engaged in the Event or any other person who assists in or provides services to Wild Arizona with respect to the Event; I specifically waive and relinquish any and all claims that Myself, My Estate, and My Heirs, might have against Wild Arizona and those persons identified in paragraph 4 above, including (but not restricted to) claims of negligence, breach of contract, or any other breach of a recognized duty at law;

In the event that Myself, My Estate, and My Heirs, cause legal proceedings to be brought against Wild Arizona and/or any of the individuals identified in paragraph 4 above, Myself, My Estate, and My Heirs agree to indemnify and to hold harmless the individuals identified in paragraph 4 above and Wild Arizona for any claims advanced, including applicable attorneys’ fees and costs;

I hereby grant Wild Arizona the irrevocable and unrestricted right to use and publish photographs and video of me, or in which I may be included, taken during the Event, for publications, electronic reproductions including web sites) and/or promotional materials or any other purpose and in any manner or medium, so long as the purpose of the publication is the promotion of Wild Arizona and causes it supports; Participant shall not be entitled to any compensation for the use of any Participant’s photos by Wild Arizona. Additionally, I acknowledge that Wild Arizona retains all right, title and interest that I may have in any versions of these materials, and I waive any right to inspect or approve finished versions of any promotional material, or to approve its future use. I do this knowingly with understanding that such legal recourse is given up in return for Participant’s participation in any and all Wild Arizona programs.

This Waiver states the entire understanding with respect to the matters discussed herein, and supersedes all prior or contemporaneous oral or written understandings, agreements, statements or promises; I agree that I had the right to consult with an attorney or other advisor in connection with the effect of this Waiver, and assume the risk arising from not seeking further or additional consultation. If a dispute arises because of this Waiver or my participation in Event, Myself, My Estate, and My Heirs waive the right to a jury trial but acknowledge that Wild Arizona and the individuals mentioned in paragraph 4 above are not waiving their right to a jury trial. Arizona law applies to any dispute arising under this Waiver or my participation in the Event

I acknowledge and agree that in signing this Waiver that I am bound by all the parts of the Waiver and that if I am not prepared to be so bound, that I have the option of not participating in the Event. In signing this Waiver, I acknowledge and agree that it is my full and lawful intention to be bound by its terms and I sign this Waiver voluntarily, having read its terms in full, and without duress, or undue influence from any person.
